1. General

  1. These "Terms of Use" describe the terms and conditions under which Services of Nazza may be used. Nazza’s Services (hereinafter referred to as "Services") consist of the provision of applications and associated actions. By the applications (hereinafter referred to as "Apps") we mean the UnlockThis App, the Moovlr App and the Mijn Nazza Web Application. The Apps are owned by Nazza N.V. established at Stationsplein 4 (5th floor), 2275 AZ in Voorburg (the Netherlands).

2. Applicability and changes Terms of Use

  1. These Terms apply to the use of our Services.

  2. You can find the Terms of Use at the following location: https://nazza.nl/terms.

  3. We have the right to unilaterally change these Terms of Use. You will be informed in time about the changed terms and conditions via a message in our Apps. You will then have the option to accept or re-accept the Terms of Use.

3. Reference to Privacy Statement

  1. The Privacy Statement known as 'Privacy Statement Nazza' is part of these Terms of Use and applies to all privacy-sensitive information or personal data that you provide to us through our Services. We attach great importance to your privacy and therefore exercise the utmost care in handling and protecting personal data. 4. Use of our Services

  1. You are responsible for the correct and careful use of our Services.

  2. In particular, you must:

    • fill in the data correctly and truthfully.

    • choose your e-mail address as your login name.

    • treat personal login codes confidentially, keep them secret for other persons and if the login code has become known to someone else, inform us immediately by sending an e-mail to: mailto: support@nazza.nl.

    • not to use our Services for actions and/or conduct that conflict with the applicable law or regulations, morality, public order or the rights of third parties, or that (otherwise) infringe the privacy of third parties.

    • not to use our Services in such a way that the (correct) functioning thereof is hindered, security is breached or damage is caused to us, our Services or third parties.

    • not to spread viruses through our Services, or otherwise disrupt devices or systems belonging to us or other users of our Services.

    • respect and maintain our good name and reputation at all times and ensure that the use of our Services does not in any way harm our rights and/or our reputation.

    • follow all our instructions and regulations for the use of our Services.

  3. If you violate these Terms of Use, we have the right to take all measures we deem necessary, such as suspending or terminating your access to our Services or recovering any damages or costs from you.

  4. You may not grant third parties access to our Services, make our Services available to third parties, sell, rent, decompile, reverse engineer or modify our Services without our prior consent. Nor may you remove or allow to be removed any technical device designed to protect the App or the physical locks with which the App communicates.

5. Intellectual property rights

  1. All intellectual property rights and/or similar rights to our Services, including the underlying software, texts, images, video and sound fragments, are held exclusively and solely by Nazza. Data that is added by you to our Services, remains your property.

  2. We grant you a (free) non-exclusive, non-sublicensable and non-transferable licence for the use of our Services within the framework of the objectives formulated by us. It is not allowed to use our Services for other purposes.

  3. Nazza appreciates any feedback you may provide on the operation of the App, but Nazza is in no way obliged to pay any financial compensation in exchange for any feedback provided.

6. Liability

  1. Our Services have been compiled with the greatest care. However, we cannot guarantee that our Services will always be available or work without interruption, errors, viruses, malware or defects, or that the information provided is complete, correct or up-to-date. We reserve the right, if necessary, to suspend our Services (unannounced) temporarily or permanently, without you being able to derive any rights from this.

  2. We have the right at all times to adapt our Services, to change or delete data, to limit the use of our Services or to deny access to our Services in whole or in part, temporarily or permanently. We will inform you of this in a timely and appropriate manner.

  3. We are not liable for damage or injury resulting from the use of our Services, unless the damage or injury is the result of intent or gross negligence on our part. We shall never be liable for indirect or consequential damage, such as loss of turnover or income. You indemnify us against all possible claims from third parties as a result of the use of our Services.

7. Cookies

  1. The Moovlr App and the UnlockThis App does not use cookies.

  2. When you log in to the My Nazza Web Application, an essential cookie is used to keep track of that you logged in and as who you logged in. Normal use of the Web Application is not possible without this cookie. No tracking and advertising cookies are used.

8. Choice of law and legal forum

  1. Dutch law applies to these Terms of Use. Disputes regarding our Services or these Terms of Use shall be settled by the competent court in the place where we are established, unless mandatory law prescribes another competent court.
